Before you sue: three things every Small Claims plaintiff should do first
You are owed money and you are done waiting. Before you file, take one afternoon to do the following — it changes outcomes more than anything that happens in the courtroom.
- Confirm the limitation period. Two years, in most cases, from when you knew.
- Send a real demand letter. Dated, on letterhead, with a deadline. It settles more claims than trials do.
- Ask the uncomfortable question: can this person pay? A judgment is only worth what you can collect.
